Welcome. These Terms are an agreement between you and us for the use of Roomy. We’ve tried to keep them readable, but they’re still real rules — please read them.
1. THE BASICS
- “Roomy” means the Roomy mobile app, the roomy.flabbergast.agency website and related services.
- “Flabbergast”, “we” and “us” mean Flabbergast Agency, Zavrtnica 17, 10000 Zagreb, Croatia.
- “You” or “User” means any person who uses Roomy.
By downloading, accessing or using Roomy, you accept these Terms and our Privacy Policy. If you do not agree, please do not use Roomy.
2. WHAT ROOMY DOES
Roomy is an AI property search assistant. Depending on your plan, you can:
- Search for properties in natural language through AI queries
- Browse listings from multiple portals in one place
- Save searches, bookmark listings and set price alerts
- View AI property summaries, neighborhood descriptions and market trends
- Export saved searches and listing data
- Use saved data offline, with syncing once you reconnect
Roomy requires an account, and the AI search features require an internet connection.
3. WHO CAN USE ROOMY
You must be at least 16 years old. You agree to provide accurate information and to safeguard your login details, and you are responsible for activity on your account.
4. PLANS, BILLING AND RENEWAL
4.1 Plans: Roomy offers a 7-day free trial, followed by a paid subscription. Current plans, features and prices are shown in the app and on roomy.flabbergast.agency when you subscribe.
4.2 Prices (for reference only, may vary by region and currency): €4.99 per month or €39.99 per year (~33% savings with annual billing).
4.3 Automatic renewal: paid subscriptions renew automatically at the end of each period unless you turn off automatic renewal at least 24 hours before the period expires. Billing takes place within 24 hours before renewal.
4.4 Managing and canceling: manage or cancel your subscription at any time through your Apple App Store or Google Play settings. Cancellation takes effect at the end of the current period — you keep access until then.
4.5 Trial period and refunds: the free trial or promotions apply under the conditions shown at the time of purchase. Any unused portion of the trial period is forfeited when you purchase a subscription. Refunds and the right of withdrawal are handled by the app store you bought through (Apple or Google) according to their policies.
4.6 Price changes: we may change prices. Changes do not affect a period you have already paid for, and we will notify you where required by law.
5. USING ROOMY
5.1 Please: use Roomy for personal real estate research, follow the laws that apply to you and respect the rights of others.
5.2 Please do not: use Roomy unlawfully or fraudulently; bulk-download listing data in violation of third-party portals’ terms; circumvent security measures; reverse engineer the app; upload viruses or malicious code; or interfere with the operation of Roomy.
5.3 Third-party content: property listings shown in Roomy come from third-party portals. We do not own or control these listings and are not responsible for their accuracy or availability.
5.4 We may temporarily or permanently revoke your access if you breach these Terms.
6. YOUR DATA AND BACKUPS
6.1 You own the data about the searches and bookmarks you create. You grant us a limited license to host and process that data so that we can provide the service.
6.2 We make technical backups, but you are responsible for keeping your own copies. Export your searches regularly.
6.3 How we process personal data is described in our Privacy Policy, which forms an integral part of these Terms.
7. IMPORTANT: DISCLAIMER OF LIABILITY FOR PROPERTY DATA
Roomy is a property search and discovery tool. It is not a licensed agent, broker or legal advisor for real estate. The information it displays — including listing details, price estimates and neighborhood descriptions — is provided for informational purposes only and may not be complete, up to date or accurate.
- Always verify property details directly with the seller or agent, or in the land registry, before making a purchase decision.
- The AI summaries and recommendations Roomy generates are supporting tools, not a substitute for professional legal, financial or brokerage advice.
- We do not guarantee that any listed property is available, correctly priced or free of encumbrances.
- Any financial decision you make based on Roomy is solely your responsibility.
8. INTELLECTUAL PROPERTY
Roomy and everything in it (code, design, features and brand) is owned by Flabbergast and is protected by law. Without our permission, you may not copy, modify, distribute or reverse engineer it. The name “Roomy” and the logo are ours. You retain ownership of your data, as set out in Section 6.
9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
9.1 Roomy is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties regarding accuracy, completeness, reliability, uninterrupted or error-free operation and fitness for your specific needs.
9.2 To the maximum extent permitted by law, Flabbergast is not liable for indirect, incidental or consequential damages, or for losses arising from the use of (or inability to use) Roomy, including reliance on property data for purchase, investment or legal purposes.
9.3 Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights under Croatian and EU law.
9.4 You use Roomy at your own risk.
10. SUSPENSION AND TERMINATION
10.1 You can stop using Roomy at any time and cancel your subscription through your app store.
10.2 We may suspend or terminate your access if you breach these Terms, with prior notice where appropriate.
10.3 After termination, some features may be limited, your data may remain available in read-only mode for a certain period, and no refund is provided for the unused portion of a paid period (subject to app store policies and your statutory rights).
11. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by Croatian law. Disputes will be resolved by the competent courts in Croatia, without prejudice to the mandatory consumer rights in your place of residence. We will first try to resolve any issue amicably.
12. CHANGES TO THESE TERMS
We may update these Terms. Significant changes will be announced in the app or by email and take effect upon publication. By continuing to use Roomy after that, you accept the updated Terms.
13. SEVERABILITY AND WAIVER
If any part of these Terms proves unenforceable, the rest remains in effect. If we do not enforce a right immediately, that does not mean we are waiving that right.
